By accessing or utilizing our Services, you verify that you have read, comprehended, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any provision herein, you must immediately terminate access to the Services.
II. Definitions and Scope of Services
NOKATI operates as an engineering organization constructing foundational digital systems, talent intelligence infrastructures, and deep technological architecture.
- “Platform”: Refers to web properties, applications, APIs, and computational systems engineered or maintained by NOKATI.
- “StarkSeek”: Refers to NOKATI’s flagship talent and skills verification platform connecting learning to verified technical employment.
- “Proprietary Architecture”: Refers to all algorithmic graphs, source code, data models, interface architectures, and system designs authored by NOKATI.
III. Acceptable Use and Platform Integrity
Users are strictly prohibited from engaging in any activity that compromises the mathematical reliability, security, or availability of our systems. You agree not to:
- Decompile, reverse engineer, disassemble, or attempt to derive the underlying source code or algorithms of any NOKATI proprietary platform.
- Deploy automated bots, spiders, or unauthorized scraping frameworks to extract proprietary data or candidate intelligence without written authorization.
- Initiate denial-of-service (DoS/DDoS) attacks, exploit vulnerability surfaces, or attempt unauthorized penetration of our cloud infrastructure.
- Impersonate any NOKATI architect, employee, or affiliated research personnel in commercial or public forums.
IV. Intellectual Property and Proprietary Rights
All visual presentations, wordmarks (“NOKɅTI”), graphical assets, typographic hierarchies, database structures, and platform code are the exclusive intellectual property of NOKATI and protected under international intellectual property conventions.
No license, right, or title to any NOKATI intellectual property is granted to you by implication or otherwise, except for the strictly limited right to access and use the public web surfaces in full accordance with these Terms.
V. Technical Verification Platforms (StarkSeek)
When using platforms such as StarkSeek for candidate verification, skill assessment, or hiring pipelines:
- Candidates and developers warrant that code submitted for evaluation constitutes their authentic original work.
- Enterprise hiring partners agree to evaluate candidate dossiers strictly in compliance with applicable employment equity and non-discrimination statutes.
- Assessment scores reflect architectural performance standards and do not guarantee statutory employment warranties.
VI. Disclaimer of Warranties and Limitation of Liability
Our Services are provided on an “AS IS” and “AS AVAILABLE” basis. While we adhere to first-principles reliability and strict architectural rigor, NOKATI expressly disclaims all warranties of any kind, whether express or implied, including merchantability or uninterrupted uptime.
To the fullest extent permitted under governing law, NOKATI and its founders shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from platform downtime, data transmission anomalies, or third-party network outages.
VII. Governing Law and Jurisdiction
These Terms shall be governed by, construed, and enforced in accordance with the laws of India, without regard to conflict of law principles. Any dispute or arbitration arising hereunder shall be subject to the exclusive jurisdiction of the competent courts of Bihar, India.
